Marshall Dennehey attorneys have a history and reputation for excellence in defending Emergency Medical Services (EMS) agencies and their individual providers in all manner of litigation, including:

We are familiar with the unique and nuanced EMS laws and regulations in the states where we practice, including those laws designed to protect first responders, some of which provide for higher standards to prove negligence. We also represent EMS clients before various governmental agencies in credentialing and licensing issues.

Brooks Foland, chair of the Emergency Medical Services Practice Group, has defended fire and EMS agencies and providers for more than 20 years in state court and before the Pennsylvania Department of Health. He is EVOC trained and certified, and is an affiliate member of the Pennsylvania Emergency Health Services Council. As leader of the practice group, his specialized background allows us to understand the specific issues that face EMS organizations and how to successfully defend claims and suits asserted against them.

With the Governor’s issuance of the Proclamation of Disaster Emergency on March 6, 2020, and with the increased demands being placed on EMS personnel and resources, the PA Bureau of Emergency Medical Services (Bureau of EMS) has relaxed certain staffing and credentialing requirements to help ease the burdens on Pennsylvania EMS agencies and providers and to facilitate and expedite EMS responses to calls for help.

Dismissal of all claims on the eve of trial where EMT plaintiff’s demand was $10 million.

The plaintiff was an Emergency Medicine Technician who was severely assaulted during an ambulance transport of a minor patient to a psychiatric facility. The client-physician had discharged the minor patient with orders for sedation and restraints, if needed, during transport. The plaintiff alleged these discharge orders were insufficient and violated standard of care. Our attorneys successfully argued that under Pennsylvania’s Mcare Act our client-physician did not owe a duty to the plaintiff-EMT, only to the minor patient.

Dismissal of claims against EMTs.

Emergency Medical Services

We obtained dismissal of claims in a negligence action in which our client’s EMTs “dropped” the plaintiff while transporting him to a rehab facility from a hospital after bilateral knee replacement surgery. The plaintiff was placed on a stretcher in his hospital room, but when the EMTs began lifting it to height, the plaintiff leaned over, causing it to tip over.
