Overview
Gary focuses his practice on Public Entity and Civil Rights Litigation and Employment Law. Over the course of Gary’s career, he has represented public entities, school districts, corporations, and both private and public sector employees in a variety of litigation matters. In addition to trying cases to verdict in both federal and state courts, he has defended matters at administrative levels, public and private hearings, and arbitrations.
Gary has represented police officers, prison officials, and public officials in state and federal court in all areas of civil rights litigation including claims involving use of force, wrongful arrest and land use. Gary also has extensive experience defending school districts, boards, and directors in First and Fourteenth Amendment claims involving novel and complex legal issues. He has counseled school districts throughout Pennsylvania and represented them in litigation against claims for bullying, hazing and sexual abuse. Notably, he successfully defended against claims of sexual contact by a teacher, claims of bullying and assault of a student, and a student’s claim of retaliation arising from a school district’s response to complaints made by a student.
Additionally, Gary defends public and private employers in all aspects of litigation involving claims for labor and employment issues, such as wrongful discharge, employment discrimination, retaliation and defamation claims, as well as violations of federal laws, including the Family Medical Leave Act, Fair Labor Standards Act, Title VII, Americans with Disabilities Act and Age Discrimination in Employment Act, among others. He has also successfully secured preliminary injunctions for clients in various employment matters involving employees defaming their employers and stealing trade secrets.
After receiving his juris doctor from Duquesne University School of Law, Gary served as the judicial law clerk for the Honorable Bruce F. Batton of the Court of Common Pleas of Dauphin County. During law school, he was a judicial intern for Chief Justice Ralph Cappy of the Pennsylvania Supreme Court as well as the Honorable Maureen Lally-Green of the Pennsylvania Superior Court.
