What’s Hot in Workers’ Comp – Special PA Alert

The Pennsylvania Bureau of Workers Compensation has revised the Notification of Suspension or Modification (LIBC-751) to comply with Act 95 of 2021, that was signed into law by Governor Wolf on December 22, 2021. The Notification of Suspension or Modification form now includes two verification boxes which must be checked before the document is signed. The Notification of Suspension or Modification form must still be sent to the claimant, claimant’s attorney, if known, and the Bureau within seven days of the modification or suspension of benefits. 

Completed forms should be uploaded into WCAIS, which is available 24 hours a day and 7 days a week. WCAIS will reflect a “filed date” when the form is uploaded so that you can easily comply with the requirement for filing the form within seven days of the claimant’s return to work. The document is then available for instant viewing by all parties to the claim. A copy must still be mailed or emailed to the claimant and the claimant’s attorney, if known, and the Bureau.

Uploading the Notification of Suspension or Modification form can be done within the “Action Tab” of a claim, using the “Document Type” Notification of Suspension or Modification (LIBC-751) in the tab’s drop-down list.

The revised form must be used beginning February 20, 2022. After March 2, 2022, prior versions of the form will be marked incomplete by the Bureau.
