Attorneys' were successful in their representation of a bike trail. The attorneys' obtained a summary judgment of no liability when the judge ruled that Plaintiff, a chiropractor and recreational trail bike enthusiast, could not recover for injuries sustained (a neck fracture) when trying to navigate his mountain bike through the branches of a tree that had fallen across a bike trail. The defense argued that having chosen to try to ride through the downed tree as opposed to going around it, Plaintiff could not reasonably expect that the tree was not without hazards. Plaintiff appealed and the attorneys' were successful in having the court's ruling affirmed.
