Attorneys obtained a defense verdict of no negligence in favor of defendant obstetrician. Plaintiffs alleged negligence in the delivery of their child when shoulder dystocia was encountered. The Minor-Plaintiff, now almost seven years old, continues to have significant functional deficits in his upper extremity related to Erb's Palsy, including a 30 degree contracture of the elbow. Defense attorney was able to convince the jury that defendant acted with the appropriate maneuvers to relieve the shoulder dystocia and successfully deliver the baby under the situation.
