Attorneys obtained a defense verdict at a Binding Arbitration. Plaintiff, a 37 year old male, claimed torn hamstrings, a ruptured piriformus muscle and eventual herniated discs and low back surgery as a result of improper stretching at a gymnastics activity at defendant's gym. Defense attorneys brought up prior issues with plaintiff's legs and back and verified the same through cross-examination by confronting plaintiff with his prior medical history. Defense attorneys also used a biomechanical engineer to indicate that these types of injuries do not happen as a result of the stretching that was done. The plaintiff proffered no expert to critique defendant's stretching exercise techniques.
