Attorney successfully obtained a Motion for Summary Judgment in a declaratory judgment action filed on behalf of a 2nd-priority UIM carrier. At issue was the amount of the credit due under the 1st-priority UIM policy, the resolution of which depended upon whether or not a Commercial Auto Ministry Use Endorsement applied to cap the 1st-priority coverage limit, under the circumstances of the accident. The court agreed with our client that it did not, and as a result held that our client was entitled to a credit well in excess of the value of the underlying claim.
