Attorney obtained a summary judgment in a brain injury case, in favor of her client, the operator of a motocross track, against the plaintiff who had an accident while participating in a motocross race.   All experts, including those retained by the defense, agreed plaintiff suffered permanent cognitive deficits as a result of the accident.  Plaintiff had no recollection of the accident but he alleged he was attempting to jump a maneuver called a single to table.  He brought a claim against our client for the negligent design of the jump and for the negligent maintenance of the track. The attorney argued there was no evidence that any condition on the property caused or contributed to cause the accident and that all of plaintiff's expert's opinions were premised on the fact that the plaintiff was actually jumping the maneuver at the time.  There was unrebutted testimony of eye witnesses found by the defense that plaintiff's bike never left the ground.  The court granted the motion, finding that plaintiff could not establish any link between any alleged breach and causation.
