Attorney obtained judgment on the pleadings in a professional negligence claim in which the plaintiff alleged that our client used a fraudulently obtained power of attorney to facilitate the sale of real property owned by the plaintiff. The Court found that the plaintiff failed to make any allegations detailing the conferral of some benefit upon our client by the plaintiff, and concluded that this lack of privity prevented the plaintiff from pleading a legally sufficient claim for unjust enrichment. On this basis, the court dismissed all claims against our client with prejudice.
