Attorney obtained a defense verdict after the court granted his motion in limine to preclude all evidence of direct damages along with any evidence of lost profits in a commercial business dispute. Our client had filed a breach of contract claim against the defendant for failure to pay for services rendered to redesign defendant's website. Defendant filed a counterclaim and alleged damages. The bulk of the alleged damages were lost business profits. A motion in limine was filed to preclude any expert testimony regarding the lost profits. The motion was granted. The court also granted a motion in limine to preclude certain documents that would have allegedly supported direct damages. The court then heard argument on a motion to dismiss the entire counterclaim. The court granted the motion to dismiss the counterclaim and allowed our client to proceed with its breach of contract claim against the defendant.
