Plaintiff’s subjective feeling that employment decision was based upon race is insufficient to allow claim to proceed.

The defendants owned and operated a wholesale auto auction, and it was alleged that it required the plaintiff to satisfy the debt of his prior employer before allowing him to register as a buyer for another registered dealership. The plaintiff alleged that this action was taken against him because of his race. In dismissing the complaint, the Appellate Division reiterated that the subjective belief of the plaintiff, without more, is insufficient to establish a claim.
