Skuse v. Pfizer, Inc., Docket No. 1-86-18 (NJ Supreme. Ct. Aug. 18, 2020)

New Jersey Supreme Court concludes that continued employment can be assent to terms of arbitration policy.

Pfizer disseminated a Mutual Arbitration and Class Waiver Agreement to its employees. The Agreement provided that continued employment by Pfizer for 60 days thereafter would be deemed to be consent to be bound to its terms and conditions. In upholding the legality of the Agreement, the New Jersey Supreme Court concluded that Pfizer’s arbitration policy sufficiently explained the implications of agreeing to arbitration and that tying assent to continued employment was permissible.
