Fla. Stat. § 409.2576

New Florida law mandates additional reporting requirements for newly retained independent contractors.

Beginning October 1, 2021, Florida businesses are required to report new hire information for independent contractors to the Florida Child Support Program. The law, enumerated in 409.2576, F.S., requires a service recipient to report basic identifying information for any newly engaged, non-employee to whom the service recipient pays more than $600 in a calendar year for services performed by the individual in the course of the service recipient’s trade or business. Previously, the law only required that employers report newly hired employees to the Department, while reporting independent contractors was optional. 

To comply with the statue, employers must make the report to the Florida New Hire Reporting Center within 20 days after the first payment to the independent contractor, or the date the business and independent contractor entered into contract, whichever is earlier. The reporting portal can be found at the Florida Department of Revenue website (https://servicesforemployers.floridarevenue.com/Pages/home.aspx.)
