Appellate Division finds that the plaintiff met the extraordinary circumstances exception to the 90-day requirement to serve a tort claims notice.

The Appellate Division of New Jersey reversed a denial of the plaintiff’s motion to file a late tort claims notice ten months after the accident which caused the injury.

The plaintiff alleged that injuries from his motorcycle accident were caused or aggravated by medical professionals employed by the state of New Jersey which left him a quadriplegic. The Appellate Division held that the plaintiff established extraordinary circumstances for the filing of a late notice of tort claim due to the severity of the injuries, physically and emotionally.
