The plaintiffs are the remaining residents of the Borough of Centralia in Columbia County, PA, where an underground mine fire was discovered in 1962 and still burns today. In 1993 the client, in providing legal representation to the Columbia County Redevelopment Authority, commenced eminent domain proceedings against the plaintiffs who elected not to participate in a voluntary relocation. The proceedings were litigated to conclusion. In 2010, the plaintiffs filed a civil rights lawsuit claiming that the eminent domain proceedings were actually a sham designed to allow the Commonwealth, in conspiracy with other parties, to deprive them of their property rights and to gain access to the underground coal. The defense prevailed on a Rule 12 motion in this civil rights action.
