Attorneys obtained Summary Judgment for a title company/closing agent in a matter before the Superior Court. Plaintiff claimed that our client improperly withheld disbursement of escrow funds after the settlement of a sale of a residential property did not go through. The Contract for Sale clearly provided that our client was not to release the settlement funds until both parties agreed to do so in writing. While Plaintiff initially agreed to the settlement funds release, the other parties to the sale did not initially. Subsequently, Plaintiffs filed the suit which we defended. The judge found that our client acted properly and in accordance with the sales Contract, including our client's immediate deposit of the escrow funds with the Superior Court of New Jersey contemporaneously with our firm filing the Answer to the Complaint.
