Attorneys obtained summary judgment in a Dragonetti case on behalf of their attorney clients. Plaintiffs alleged that the attorneys wrongfully initiated and continued legal proceedings against them. In the underlying case, the plaintiff, with the assistance of our clients, filed civil actions against her sister and her sister's husband, a real estate attorney, asserting that they had wrongfully influenced her mother into deeding the family farm to them after she became terminally ill. Mother had previously prepared a Will which provided that the two daughters would receive equal shares of her Estate upon her death. The estate, however, was essentially worthless as a result of the inter-vivos property transfer. The Court held that our clients did have probable cause to initiate and continue the underlying proceedings on behalf of their client.
