Attorneys obtained summary judgment in a case where Plaintiff, a temporary employee, was assigned to work at a distribution center. He was operating a pallet jack to disassemble racking and conveyor parts as part of the renovations at the distribution center. One morning, plaintiff lost control of the pallet jack and pinned his leg between the jack and the conveyor parts. Plaintiff sustained a laceration to the calf, requiring stitches, and a fractured ankle, resulting in osteochondral defect and Reflex Sympathetic Dystrophy ("RSD"). Our insured, the distribution center, moved for summary judgment based on the Borrowed Servant Doctrine.
