Attorneys obtained dismissal of plaintiff's attorney malpractice complaint for plaintiff's failure to serve an Affidavit of Merit as required by the New Jersey Affidavit of Merit Statute.  Plaintiff subsequently filed a Complaint in which he alleged that our client did not have workers' compensation insurance.  The client did have workers' compensation insurance, but the plaintiff had never placed our client on notice of a claim.  A Motion for Judgment on the Pleadings was filed immediately after our Answer was filed.  We argued that plaintiff's claim was precluded by the Workers' Compensation Act and that plaintiff also named our client as a defendant after the Statute of Limitations had expired.  The Court granted the Motion and dismissed all claims against our client with prejudice.
