Attorneys obtained a defense verdict in a premises liability case involving a trip and fall over a small (2") step at the entrance to a restaurant, resulting in serious facial fractures and nerve injuries. It was recognized at the outset of the case that the step was in clear violation of a number of industry codes and standards including the International Building Code, the International Fire Code, and several ASTM and ANSI sections, so the defense was not able to present an expert to oppose the plaintiff's liability expert at trial.
