Attorneys obtained a defense verdict in a medical negligence case. Plaintiffs claimed that the defendant ob/gyn was negligent during a laparoscopic bilateral tubal ligation resulting in injury to the patient's left common iliac artery, requiring emergent conversion to an open procedure as well as multiple blood transfusions. Plaintiffs' theory was that this injury could only occur if the surgeon was off midline and too deep during the procedure. The case was complicated by postoperative conversations between the physician and patient that the Court allowed the jury to consider, including the fact the physician provided the name and phone number of her malpractice carrier. The jury returned a verdict in favor of the physician on standard of care.
