Attorneys obtained a defense verdict following a 3 week trial involving the death of a 71 year old woman who, following a routine cardiac catheterization, suffered a retroperitoneal bleed which, 2 days later, resulted in a cardiac arrest due to hypovolemic shock from which she never recovered and died 3 months later. There were multiple defendants, one of whom was a cardiologist who pre-trial reached an MCARE 714 quasi joint tort settlement and conceded liability but against whom plaintiff still had to prove their case in order to recover against MCARE; as well as another cardiology defendant against whom plaintiff put on no expert testimony as part a pre-trial deal. The remaining 3 defendants who were involved in various stages of post-catheritization treatment proceeded to trial. Both of the cardiology defendants were kept on the verdict sheet and the jury found our client as well as two other physicians not negligent however returned a verdict solely against the "settling" cardiology defendants. Notwithstanding the verdict, plaintiff’s recovery will be significantly reduced based on the pre-trial settlement agreement with the cardiology defendants.
