Attorneys obtained a defense verdict on behalf of a Podiatrist in which it was alleged that he failed to schedule a timely follow-up visit for evaluation of a toe injury on a 75 year old diabetic with severe peripheral vascular disease. Three weeks after the visit with our client, he presented to the hospital with a severe infection which initially required a partial amputation of the affected toe. As a result of his diabetes and PVD, he was unable to heal and over the course of the next year underwent 4 additional amputations the last of which was an above knee amputation. Plaintiff ultimately died from unrelated causes and the survival action damage claim was based on the pain and suffering he endured in undergoing a total of 5 amputations in an 18 month period. Although our client's treatment records were poorly documented, our defense was based on traumatic incidents which occurred subsequent to the visit with our client and the jury returned a defense verdict within an hour of deliberation.
