Attorney successfully defended a legal malpractice claim by filing a motion to dismiss in lieu of an answer.  The motion sought to dismiss the complaint on the grounds that the attorney did not owe any duty to the former plaintiff against whom he defended a personal injury claim, lack of proximate causation, the defense of the litigation privilege, and collateral estoppel.  Upon receipt of the motion, plaintiff's counsel voluntarily filed a stipulation of dismissal with prejudice.
