Attorney recently received summary judgment on behalf of the owner of a rental unit in Kent County, Delaware. The claim arose out of a trip and fall accident for which the plaintiff suffered an aggravation of C3–C4 and C4-C5 herniations with radiculopathy, a fracture of the malleolus, and a tear of the left rotator cuff and was later diagnosed with Complex Regional Pain Syndrome. Following oral argument, the judge granted summary judgment upon a showing of various medical records that plaintiff filed her Complaint three days after the running of the two year statute of limitations notwithstanding plaintiff's claims to the contrary.
