Attorney obtained summary judgment in favor of a Hospital in a medical malpractice case. Plaintiff claimed that medical personnel at the Hospital failed to order deep venous thrombosis prophylaxis for plaintiff's decedent during her admission at the Hospital in the presence of symptoms and risk factors, ultimately resulting in the decedent's death. Plaintiff also claimed that while the plaintiff's decedent was a resident of co-defendant apartment complex, she fell resulting in a fracture of the distal femur, which lead to a pulmonary embolism and her death. After obtaining favorable testimony from the daughters of the decedent, establishing that the decedent had a long standing relationship with the physicians alleged to be ostensible agents of the Hospital, the attorney persuaded the court that plaintiff would be unable to prove that the physicians alleged to be negligent were ostensible agents of the Hospital.The attorney further persuaded the court that plaintiff failed to support her claims of negligence against the Hospital with the requisite medical expert testimony.
