Attorney obtained a fully favorable decision dismissing a claim petition on behalf of a staffing agency employer and its TPA. In her petition, claimant was seeking ongoing disability benefits due to an alleged repetitive usage injury to both extremities. However, through an analysis of claimant's medical treatment records contemporaneous with the alleged injury date and by highlighting discrepancies in claimant's own testimony, the attorney was able to demonstrate that claimant failed to report any work-related injury and had an unknown etiology of symptoms. When she did seek treatment, claimant reported a different "specific incident" work injury versus a "repetitive use" work injury. As such, claimant's treating physician was discredited as relying upon claimant's history and the defense medical expert testimony was accepted. The decision was not appealed.
