Attorney obtained dismissals of two professional malpractice actions filed against our client, a prominent title company. Our client was joined to two cases as a third-party defendant by the third-party plaintiff who faced foreclosure on several investment properties spanning five counties. All matters were consolidated and handled by one judge. The third-party plaintiff brought claims of negligence and fraud for our client's handling of two of the investment property closings. After conducting discovery, the attorney sought leave of court to file motions to dismiss these matters with prejudice and an award of counsel fees. The third-party plaintiff, when faced with the application, consented to dismissals with prejudice.
