Attorney obtained a dismissal of a professional negligence and civil rights claim . Plaintiff was injured when the ATV he was operating on a state-owned road was overturned by a State Police Officer, who was pursuing plaintiff for suspected traffic violations. Plaintiff retained our clients to pursue civil rights claims against the Commonwealth and the Officer. After plaintiff's claims proved unsuccessful, plaintiff sued our clients alleging that they were negligent in their representation of plaintiff's interests, and that they violated plaintiff's civil rights by conspiring with the State Police to destroy video footage of the Officer's pursuit. The court granted our motion to dismiss as to all claims, concluding that plaintiff had failed to meet the pleading threshold necessary to allow his claims to survive.
