Attorney obtained a dismissal of a lawsuit brought against a surveyor. Sellers sold a parcel of land to Plaintiffs. The Plaintiffs alleged that they thought that they were purchasing a parcel that was 2.91 acres in size, but that after the sale, they learned that the parcel was only 2.29 acres in size. The plaintiffs sued their real estate agent; the sellers; the surveyor; the closing agent; and the owner's title insurer. After a review of all land sale records, the courthouse records and the depositions of the parties, the attorney was able to convince Plaintiffs' counsel that the surveyor (who had surveyed the property twice before the closing) was not at fault, and that the crux of the case was a courthouse recording error that pre-dated all transactions involving the parties. Plaintiffs filed a notice of dismissal of claims against the surveyor. After Plaintiffs dismissed the surveyor, the case was tried. The jury, incidentally, returned a defense/no liability verdict as to the remaining defendants.
