Attorney obtained a dismissal of a claim petition for total disability benefits after a trial. The injured worker fell through a roof and sustained a fractured back resulting in a claim for permanent/total disability benefits. The trial was bifurcated to first deal with the issue of employment. At the time of trial, the petitioner had already racked up a large sum in benefits and, given his life expectancy, the total exposure would have been more substantial. The attorney was able to prove to the court that our client, the general roofing contractor, did not exercise enough control over the petitioner to be considered a joint-employer. The attorney took over the case from in-house counsel on the eve of trial after nine years of discovery. The dismissal after trial reversed an earlier Court Order denying the employer's Motion to Dismiss.
