Attorney obtained dismissal of all claims against a police officer who participated in service of a search warrant at the home of the plaintiff, a now-disbarred local attorney, serving time for his conviction for solicitation to commit murder. As part of the underlying investigation of plaintiff's attempts to hire an undercover police officer to kill two witnesses to plaintiff's drug use and business plan to open two brothels in different counties, our officer, literally , sat in a driveway, while detectives gathered evidence inside plaintiff's home. Plaintiff argued that the refusal of the detectives to turn back over a computer (allegedly containing child pornography), and business records, was conduct attributable to all present for the warrant. The Court disagreed.
