Attorney obtained a defense verdict following a six-day jury trial. The plaintiff, an elderly woman walking behind her daughter and grandchildren, fell off the side of a curb after shopping at the client's store.  She sustained significant injuries to her face including a fractured nose requiring three surgeries to repair, bilateral crushed lacrimal ducts also requiring three surgical procedures, and a laceration to her cheek requiring nineteen stitches.  She claimed permanent, irreparable damage to her tear ducts resulting in an inability to drive a car and to read.  She also claimed a permanent loss of smell as a result of the accident. Although the jury found that the defendant was negligent, it also found that the defendant's negligence was not a factual cause of the plaintiff's accident.
