Attorney obtained a defense verdict in Federal Court. The case involved an allegation that a female Police Officer intentionally ran down a suspect fleeing from minor summary offenses. Plaintiff, in alleging that the Officer's use of a police car was excessive force in violation of the Fourth Amendment, presented four experts and had wage loss claims. After successfully having the municipality dismissed through summary judgment, the Court granted, on the eve of Trial, a Daubert Motion precluding Plaintiff's liability expert from testifying. The Court agreed that the jurors' decision as to whether this was an accident or an intentional seizure pursuant to the Fourth Amendment was not aided by plaintiff's police liability expert.
