Attorney obtained a defense verdict in a case wherein plaintiff was a tenant in a multi-unit apartment house owned by defendants. Plaintiff fell on steps while exiting his apartment and suffered a severe leg fracture. Plaintiff claimed that a step tread broke as he was descending and that the steps decayed as a result of a leaky rain gutter positioned directly above the steps. Plaintiff testified that he had notified defendants about the leaky gutter, but defendants denied that plaintiff had ever warned them about the leaky gutter and further denied that the steps were in disrepair. The case was tried without limits and the judge returned a decision in favor of defendants and against plaintiff.
