Attorney obtained a defense verdict after a jury trial. The case involved allegations of professional negligence (legal malpractice), breach of contract, breach of fiduciary duty, fraud and intentional failure to disclose by the defendant attorneys who drafted a deed which conveyed an 84 year old woman’s interest in land to her eldest son. The eldest son had secretly taken his mother to see the defendant attorneys nine times over a 2 ½ year period in order to have the property conveyed to himself rather than to his younger brother as originally suggested by their late father’s estate plan. The mother and younger son had already sued the eldest son in a prior action and the court in that action determined that the elder son exercised undue influence and duress upon his mother and rescinded the deed conveying the property to the eldest son. At the close of the plaintiffs’ case against the defendant attorneys, a non suit was entered as to all claims except professional negligence and the younger son was dismissed as a party-plaintiff due to his lack of attorney/client relationship with the defendant attorneys. After less than 15 minutes of deliberations, the jury returned a verdict in favor of the defendant attorneys.
