Although it was conceded that plaintiff had objective evidence of significant asbestos exposure, The attorney argued that asbestos exposure is not a scientifically accepted cause of adenocarcinoma of the esophagus and that Plaintiff’s cancer was caused by his 9 year history of GERD.
