Attorney obtained a court order and opinion under which the court granted our broker-dealer client's Motion to Compel Arbitration. The court's granting of the Motion to Compel Arbitration was unique since the court compelled arbitration of all claims against all Defendants even those Defendants who are not a party to the Arbitration Agreement. The court accepted our arguments that the non-signatories to the Arbitration Agreement were bound since there was a common and employee/officer for the signatory and non-signatory Defendants and since the remaining non-signatory Defendant's corporate structure was intertwined with the corporate structure of the signatory Defendant. The court also accepted our arguments under equitable estoppel since it appeared from the documents relating to the complained of transaction that the signatory Defendant was in fact the target Defendant of the claim.
