We obtained a decision in an administrative proceeding before the Pennsylvania Department of Insurance in favor of the insurer. The insured had filed a complaint with the Department of Insurance. The initial ruling by the Department (entered prior to the referral of the case to our firm) was in favor of the insured and included a finding that the insurer had violated Act 68 when it rescinded the policy (an issue that the Department had raised sua sponte during its review of the complaint). We appealed the Department's ruling and requested an administrative hearing to determine the legitimacy of the denial of the claim and the policy rescission. The order from the Insurance Commissioner dismissed the insured's challenge to the claim denial for lack of jurisdiction.The Commission also reversed its earlier determination that a policy rescission had violated Act 68.
