Attorney was able to get Plaintiff's sole claim against our attorney client dismissed by way of Preliminary Objections filed in the Philadelphia County Court of Common Pleas. In this case, the Plaintiff brought a fraud claim against our client, asserting that he fraudulently induced her to settle an underlying dram shop action which she had previously brought against the attorney's client. The Plaintiff alleged that the attorney fraudulently misrepresented that his client had the financial means to enter into a monetary settlement agreement, when he knew that his client was not solvent. The Plaintiff contended that since the attorney's client did not pay the settlement proceeds, the attorney should be held liable to her for the amount of the settlement. The Court dismissed the claim with prejudice.
