Attorney successfully defeated a Claim Petition where we admitted an injury and denied disability on the basis that the Claimant was terminated for cause. The Claimant alleged orthopedic as well as neurological injuries and presented one medical expert whose opinions were not found credible on the basis of our cross-examination regarding the physical examination, lack of review of medical records and diagnostic study films, and lack of any treatment to her alleged head injury. We presented a board certified neurologist, supporting no head injury, and a board certified orthopedic surgeon, as well as a panel physician, who both opined that the injuries were soft tissue in nature and that the Claimant was capable of returning to work, which was available but for the Claimant's termination for cause. The termination for cause evidence was found credible, and it included five fact witnesses from the employer. As a result, the Claimant's benefits are on a Suspension status. The award for any disability benefits was completely defeated. The only liability awarded were medicals, which were already being paid based upon the admission of an injury.
