Attorney obtained dismissal of plaintiff's claims seeking both consequential and punitive damages against an insurance company. The claimant alleged that the insurer acted in bad faith in disclaiming coverage, resulting in the insured being charged with driving without insurance. The plaintiff alleged both negligent, reckless and intentional conduct against the insurer. The trial court concluded that issues of fact relating to the underlying coverage issues required that the court grant summary judgment on the extra-contractual and bad faith claims.
