Joy v. Equifax, Inc., Docket No. 12-4497 (U.S.D.C., 4/29/13)

New Jersey Law Against Discrimination recognizes alcoholism as disability.

The plaintiff was employed by Equifax and was notified that his position was being eliminated. He applied for a number of open positions at Equifax and alleged that he was not hired because he was an alcoholic. Equifax sought to dismiss the claim by arguing that alcoholism was not recognized under the NJLAD as a protected disability. The District Court rejected this argument and found that alcoholism was protected under the statute.
