Defense Verdict Puts Racetrack Owners in Victory Lane

Obtained a defense verdict on behalf of the owners of a sprint car racetrack following a six-day jury trial in a case that attracted a high amount of media attention in the Central Pennsylvania area.  The plaintiff was a young but experienced sprint car driver who became permanently paralyzed when, during the course of a race, his car collided with another and flipped out of the track. In suing the racetrack, his principal claim was that the track was poorly designed and failed to keep his car on the track after the initial collision.

Defense Verdict for Truck Driver Hauling Fracking Equipment

Obtained a defense verdict in an automobile liability trial on behalf of an international oilfield services company and its employee.  The employee was operating a semi-trailer truck while hauling 40,000 pounds of hydraulic fracturing drilling equipment.  The plaintiff alleged that she was rear-ended by the truck while attempting to merge onto the highway at a cloverleaf intersection.  The plaintiff's passenger vehicle was pushed off the highway and rolled multiple times. Through the testimony of an accident reconstruction expert, the defense effectively established

Appellate Court Upholds Qualified Immunity for Police Officer

Successfully defended an appeal on behalf of a police officer before the Third Circuit Court of Appeals.  In this civil rights case, the plaintiff alleged malicious prosecution, a violation of §1983, in connection with his arrest in a shooting investigation.  The arresting officer was the investigator of the shooting and during that investigation, the officer received information from an informant that the arrestee was bragging about having shot someone.  Based on that information, the investigating officer created a photo array line-up of six individuals.  The shoo

Mother Not Liable for Son's Actions Under Restatement (Second) of Torts

Representing the mother of a mentally ill individual who went on a shooting spree at a psychiatric institute in Pittsburgh, the defense prevailed on preliminary objections in the nature of a demurrer in her favor. The shooting incident resulted in one death and personal injuries to several others and received a great deal of media attention. The plaintiffs claimed the shooter's mother should be liable because she "took charge" of her adult son and voluntarily assumed a duty to control him.

Police Officer's Injury No Fault of Training Company

Obtained a defense verdict in Philadelphia's Court of Common Pleas after a six-day trial. The defense represented a company with a 20-year history of teaching defensive tactics to police, military and federal law enforcement. The company was providing training to police officers of a national railroad service provider when an extremely out-of-shape officer was injured during the warm-up exercises. The officer suffered a rotator cuff tear which required surgery and resulted in full disability.
