Am. Mushroom Coop. v. Saul Ewing Arnstein & Lehr, LLP, No. 1780 EDA 2022, 2023 WL 2784806, at *1 (Pa. Super. Ct. Apr. 5, 2023)

Pennsylvania Superior Court affirmed judgment on the pleadings in legal a malpractice case based upon the statute of limitations.

The plaintiffs alleged that the court erred in not allowing them to amend their pleadings in order to clarify facts regarding equitable tolling and erred in not recognizing that issues of fact existed. The trial court found, and the Pennsylvania Superior Court agreed, that without regard for an email from counsel that the plaintiffs believed was deceptive, the plaintiffs knew of its alleged harm when they entered into a consent decree with the Department of Justice.
