Florida court upholds summary judgment for high school based on a pre-game release to play soccer.

An executed pre-game release barred a claim of negligence. The claim came from an allegation that a collision caused the student to be thrown into a cement barrier that should not have been close to the field and that the barrier was not a natural part of the activity. The court found the release was clear and unambiguous as to releasing the school board for any injury or claim from athletic participation and that there was no qualifying provision as to what claims were being released. This opinion has not yet been published and contains a dissent with opinion.
