Defense Verdict for Tractor-Trailer Owner and Operator

Obtained a defense verdict in a trucking & transportation case following a two-week trial in the Philadelphia Court of Common Pleas. The case involved a tragic accident that resulted in the death of a 29-year-old woman four days before Christmas. We represented the owner and operator of the tractor-trailer that caught fire following a blown tire in the Lehigh Valley Tunnel. As a result of this initial incident, traffic through the tunnel was stopped completely while the tractor-trailer fire was being extinguished.

Product Liability Lawsuit Against Global Table Saw Manufacturer Dismissed for Lack of Personal Jurisdiction

Obtained dismissal of our clients for lack of personal jurisdiction in Philadelphia County. The plaintiff alleged that he sustained major lacerations and nerve damage to his right hand while using a table saw in the course and scope of his employment. The plaintiff brought suit against our client, a multinational manufacturer of the table saw, as well as several United States distributors. Brad and Kaitlin filed preliminary objections on the jurisdictional issue seeking dismissal of our clients.

Accounting Firm's Professional Liability Lawsuit Dismissed

Obtained a dismissal with prejudice of a multi-million-dollar lawsuit in the Philadelphia Court of Common Pleas against our client, a large, regional accounting firm. The claims arose from our client’s auditing and SEC-reporting work on behalf of a Texas financial firm in relation to what turned out to be an organized-crime scheme to siphon millions of dollars from the firm. The plaintiff was the lawyer for the mob-controlled entities whose sales facilitated the looting.

Apartment Complex Not Liable for Slip-and-fall

Obtained a defense verdict in favor of a Jacksonville apartment complex following a three-day jury trial. The plaintiff alleged that on a rainy day, when exiting the apartment complex’s leasing office, she slipped on the top step of the stairway leading from the leasing office to the parking lot. The plaintiff claimed that she suffered a concussion, a torn rotator cuff, a partial tear of the superior labrum and permanent back pain. She subsequently had surgery to repair her rotator cuff and superior labrum.

Defense 'SLAPPS' Plaintiffs' Case

In this non-profit agency directors and officers liability case, our client, a non-profit environmental protection association, was dismissed with prejudice on preliminary objections in the Court of Common Pleas of Butler County, Pennsylvania. The plaintiffs were a group of residential homeowners who leased portions of their properties to Marcellus Shale energy companies. The defendants included our client and other nearby property owners who had filed a claim with a local zoning board challenging the ordinance allowing the drilling.

Successfully Defended FOP Lawyer in Legal Malpractice Case

Marshall Dennehey attorneys obtained a directed verdict after a four-day jury trial in Philadelphia County. The plaintiff, a Philadelphia police sergeant who had been discharged, sued the lawyer provided by the FOP at a grievance arbitration on the basis that, had the lawyer done a better job, he would never have been fired.

Defeated Teacher's "Screwy" Claim Petition

Obtained a favorable decision defeating a claimant’s claim petition. The teacher/claimant alleged that a student threw a “very large, heavy” screw at her, hitting her head just above her ear, resulting in pain, dizziness, and difficulty with balance coordination and memory. She sought immediate treatment at a hospital and, thereafter, with her own physicians. The claimant was diagnosed with post-concussive symptom, close head injury, traumatic headaches, vestibulopathy and encephalopathy.

Summary Judgment for a Family-owned Funeral Home

Marshall Dennehey attorneys successfully defended a family-owned funeral home in New Jersey. The plaintiff, a 46-year-old woman whose father was tragically killed, called the funeral home per her father’s express last wishes to have an open-casket funeral service there. However, the plaintiff did not have much money and asked the funeral director to contact her estranged uncle to see if he would pay for his brother’s funeral.

Successfully Defended the GC for the Tappan Zee Bridge Rehabilitation Project

Successfully defended the general contractor on a project to rehabilitate the Tappan Zee Bridge after a six-day bench trial in the U.S. District Court for the Southern District of New York. Our client chartered a barge as a floating work platform and entered into a subcontract agreement with a tug operator, whose tug was used to ferry electricians to the work site. Our client’s employee, a barge deckhand, fell into the river after an impact between a tug and the barge.

Summary Judgment in High Exposure NY Construction Accident Case

Obtained summary judgment in a construction accident case filed in the New York Supreme Court, Bronx County, that had a potential seven-figure exposure. The plaintiff allegedly sustained brain and other injuries when struck by a steel stud that fell from the third floor of the premises. He filed suit against the general contractor and seven of its subcontractors, including our client, who provided a hoist, among other things. The defense first successfully obtained an order directing the general contractor to make the construction site available for an inspection.
