Marshall Dennehey’s Appellate Attorneys Achieve Precedential Decision Reversing Federal District Court’s Denial of Qualified Immunity for Police Officers

Our attorneys obtained a unanimous, precedential decision in the Third Circuit reversing a federal district court’s denial of qualified immunity for their police officer clients.  The plaintiff was a passenger in a car struck by a bullet fired by one of several officers who engaged the vehicle as it sped into a populated area on the main drag through Pittsburgh’s south side. The officers, working secondary duty as security guards at bars, opened fire after the vehicle ran a red light, led cruisers on a five-mile chase, failed to obey orders to stop, swerved in and out

Claim and Penalty Petitions Successfully Dismissed

Successfully defended claim and penalty petitions where the claimant alleged that he sustained Charcot foot and specific loss of three toes as a result of an injury that occurred at work. The defense offered testimony from three employer fact witnesses. Additionally, there was testimony from medical experts regarding the serious nature of the injury and causality.

Claims Against POA Become DOA

Obtained summary judgment in favor of a large Property Owners Association located in Fort Myers, Florida. ​The lawsuit was filed against the POA by three of the condominium associations that represent the 220-condominium unit owner members of the POA.

Defense Successfully Litigates Termination Petition

Successfully litigated a termination petition on behalf of a retailer. ​The claimant sustained a work-related hand injury, for which he underwent surgery. The defense presented substantial evidence via the defense medical expert, who had the opportunity to review all of the claimant’s medical records and diagnostic study films and perform two comprehensive physical examinations. The doctor ultimately concluded upon the second exam that the claimant was fully recovered. His testimony was accepted by the Workers’ Compensation Judge, and the termination petition was granted.

Defense Verdict for Internist

Obtained a defense verdict in a medical malpractice action regarding alleged negligence and informed consent in a four-week trial in Bergen County, New Jersey. The plaintiff alleged that our client, an internist, negligently prescribed an iron infusion to a 52-year-old man with severe anemia (from newly diagnosed colon cancer). During the test dose of the iron, the decedent had a reaction that was unobserved by the nurse, which continued until the decedent had a cardiac arrest. He was resuscitated, but he died a day later.

Defense Verdict in Commercial Litigation Case

Obtained a defense verdict on all claims in a breach of contract/quantum meruit action in Chester County. ​The matter involved a dispute between a premium financing company and a Managing General Agent (MGA) concerning the financing of an insurance policy for the A&E client of a retail agent (who defaulted under the agreement). The defense successfully argued that there was no privity and that no contract existed between the Premium Finance Company and the MGA; thus, there was no legal basis for the contract claim to proceed against the MGA. 

Father Changes Will; Son Files Civil Action Against Estate Attorney

Successfully defended an attorney in his individual capacity and in his capacity as executor of an estate. The plaintiff (the decedent’s son) had a verbal agreement to move into the decedent’s (his father’s) home and provide him with care. In exchange, the decedent agreed to leave his entire estate to the plaintiff, and he did so in a Will executed in 2010. After a deteriorating relationship, in May 2013 the decedent executed a new Will that essentially left the plaintiff with nothing.

Financial Advisor Exonerated in FINRA Arbitration

Received a defense decision in a Financial Industry Regulatory Authority (FINRA) binding arbitration proceeding conducted in Pittsburgh. ​The 78-year-old investor sued her financial advisor for breach of contract and breach of fiduciary duty, alleging that he failed to properly invest the cash in her IRA account, resulting in a rate of return that was much lower than allegedly promised by the advisor.

Jury Agrees Plaintiff Does Not Have Asbestosis

Obtained a defense verdict after a two-week jury trial. ​The 64-year-old plaintiff contended that he developed asbestosis, which required him to use oxygen 24 hours a day, as a result of working with welding rods while working as a welder throughout his career. The defense presented evidence that welding rods do not release free respirable asbestos fibers and that working with welding rods does not expose the welder to asbestos.
