Illinois Court of Appeals adopted our brief and declined to recognize the tort in a case of first impression involving a claim for educational malpractice against aircraft flight schools and instructors. Our brief provided a detailed survey of how courts in other jurisdictions handle educational malpractice claims; presented an overview of the applicable FAA regulations concerning the certification of flight instructors and the certification and operations of flight schools; and explained the public policy reasons why the Illinois Supreme Court would likely join the majority of other jurisdictions in declining to recognize educational malpractice as a valid cause of action, particularly in the context of this case.
