Attorneys obtained summary judgment dismissing the Complaint against our client which is a wholesale surplus lines insurance broker. The case against our client centered on a typographical error in a notice to the retail insurance agent advising that the insured's builder's risk policy would terminate in 2009 versus the actual policy termination date of May, 2008. Subsequent to the policy termination date in 2008, Plaintiff's expensive vacation home suffered an explosion resulting in significant damage. However, the court ruled that the typographical error was insufficient to support any of the claims pled and dismissed the action.
